VigilX Networks complies with the Digital Millennium Copyright Act (DMCA) and will respond promptly to notices of alleged copyright infringement that comply with the DMCA. These notices must be submitted in writing to VigilX Networks’ designated DMCA Agent.
A valid DMCA takedown notice must include:
A physical or electronic signature of the copyright owner or an authorized agent;
Identification of the copyrighted work claimed to have been infringed;
Identification of the material that is claimed to be infringing and where it is located on the site;
Contact information of the complaining party;
A statement of good faith belief that the use of the material is not authorized;
A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.
Upon receipt of a valid DMCA takedown notice, VigilX Networks will remove or disable access to the infringing material and notify the user responsible for the content. The user may then file a counter-notification if they believe the takedown was in error.
Copyright owners or their agents may file a DMCA takedown notice with VigilX Networks if they believe their copyright has been infringed. Notices should be sent to the designated DMCA Agent at [email protected].
Upon receiving a valid DMCA takedown notice, VigilX Networks will take action within a reasonable timeframe, typically within 72 hours. This action may include removing or disabling access to the allegedly infringing material.
VigilX Networks will notify the user responsible for the content that a takedown notice has been filed and that the content has been removed or disabled. The user will also be informed of their right to file a counter-notification if they believe the removal was unjustified.
If a user believes that their content was removed or disabled as a result of a mistake or misidentification, they may file a counter-notification with VigilX Networks. The counter-notification must include:
The user’s physical or electronic signature;
Identification of the material that has been removed or disabled and its location before removal;
A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled due to mistake or misidentification;
the user’s name, address, and telephone number;
A statement that the user consents to the jurisdiction of the federal court in their district, or if outside the U.S., the district where VigilX Networks is located.
Upon receiving a valid counter-notification, VigilX Networks will forward it to the party who submitted the original DMCA takedown notice. If VigilX Networks does not receive notice of legal action from the original complainant within 10 business days, the removed material may be restored or access re-enabled.
If no legal action is pursued within the specified timeframe, VigilX Networks will restore the content or re-enable access to it. The user will be notified accordingly.
VigilX Networks keeps track of users who have repeatedly violated copyright policies. A record is maintained of DMCA takedown notices filed against a user’s content and any counter-notifications submitted by the user.
Users who are determined to be repeat infringers, typically after three instances of copyright infringement, may have their accounts terminated. VigilX Networks reserves the right to terminate accounts without prior notice if the user’s actions warrant such a response.
Users whose accounts are terminated under the Repeat Infringer Policy may appeal the decision by providing evidence or arguments to VigilX Networks. Appeals must be submitted within 30 days of the termination notice.
VigilX Networks is not liable for any actions taken by users that violate copyright laws. Users are solely responsible for the content they upload, share, or distribute using VigilX Networks' services.
VigilX Networks’ liability for any actions taken in response to copyright infringement, including the removal of content or termination of accounts, is limited to the maximum extent permitted by law.
VigilX Networks provides its services "as is" without any warranties, express or implied, regarding the non-infringement of third-party rights or compliance with copyright laws.
VigilX Networks reserves the right to modify or update this Copyright Policy at any time. Users will be notified of significant changes to the policy via email.
